Two Defense Verdicts in One Week
Melanie Carpenter and James Moore defended a Custer State Park tour jeep driver in a personal injury case commenced by Phillip Finkle in Federal District Court in Sioux Falls. Mr. Finkle alleged that the jeep driver, employed by Regency CSP Ventures / Ramkota Companies, caused his injury when the motorcycle he was driving crashed. The jury found for the defendant, awarding Mr. Finkle nothing.
Plaintiffs Richard and Susan Karst claimed that an electric tarp system manufactured by a company now known as Shorma Company and installed on a grain trailer caused a head injury to Mr. Karst. After over two weeks of trial in McIntosh, South Dakota, the Corson County jury found in favor of the defendants. The jury composed of 7 women and 5 men found the electric tarp system was not defective and the manufacturer was not negligent. Jeff Shultz and Jim Power represented Shorma Company.
